Employees do not have to make certain grades. They be will not be limited to 4-6 "years of service" before being declared past eligibility, which opens the employer up to an age discrimination lawsuit. On the positive, when I worked for University Hospital, I received free tuition for two years, but was responsible to pay back the tuition if I didn't get a C or better. Really missed that benefit when the hospital went private in '96.

Yes but the the fact that it's eventually headed for the Ninth Circuit is definitely not a good thing for the defendants in the case.
