  • The NCAA on Thursday announced significant penalties for the Florida State football team -- including two years' probation and disassociating with its NIL collective for one season -- for violating rules on using name, image and likeness offers as a recruiting inducement.

    In addition, an FSU assistant coach, which sources confirmed to ESPN as offensive coordinator Alex Atkins, was suspended three games for his involvement. The university also must disassociate with a specific booster for three years.

    Those penalties mark the first time the NCAA has severed the relationship between a school and its NIL collective as part of an infractions case. It also is the first time the NCAA has punished a school, coach or collective for using NIL as an inducement.

      • Someone needs to help me understand the meaning of the word "significant".

        Sure, FSU lost a couple schollys and a handful of recruit contact hours. But the most "significant" penalty that FSU has to take a one year break from brokering relationships between the prospects and its NIL collective. The prospects are still more than able to meet with and benefit from that collective on their own

          Reading the article, I'm not sure where the NIL collective even really came into play here. This a good old fashioned pay for play from a booster. I guess the booster donated to or spoke on behalf of the collective therefore....It's the collective's fault?

          • One of the things that's popped up here in people reading the full text of the NCAA's proposal is that Agent registration is voluntary and many of the big agency firms and consultants aren't going to do it because the NCAA has not provided transparency on what information is being collected and how that information is being shared and with whom.

            • This is paywalled most likely but if you can read it, this a very interesting article which hashes out the numbers and tells us that NIL collective donations are NOT damaging Athletic Dept fundraising for almost all of the D1 schools. It doesn't mention UC specifically but they did talk to the UCF AD and he's saying that their dept fundraising for scholarships and facilities is at or near an all time high even with the NIL collective taking in money. ($?)

              • Careful with interpreting the stats on the second link. It’s only a one year comparison and we had just come out of the CFP and capital project for the IPF.

                  The sportico.com article does mention UC specifically as a school whose non-NIL donations are down (19.1%). The largest loss was for Miami-OH (32.2%). UC assistant AD, John Daniel was quoted as saying it's too early to tell if NIL donations are to blame.

                  • So this is fun. Looks like Matt Brown and Andy Wittry got ahold of the public IRS 990 data for several schools. These list the amount of revenue and expenses generated by the NIL collectives. They listed about 50 of the FBS schools. Unfortunately the data either hasn't been published or they did not ask for UC's data for Cincy Reigns.

                    A couple of things here is that the Big XII Schools listed in the report vastly vary on the revenue of their collectives to a point where you can tell who's all in on NIL and who's disorganized.

                    Quick breakdown of BIg XII schools that reported.

                    Kansas -1.9M revenue
                    OK St -2.3M
                    Tech -2.8M
                    K-State -110K
                    TCU -154K
                    Iowa St. -658K

                    In comparing these to some of the powerhouse Athletic Depts, I ran into the fact that some schools such as Texas and tOSU have NIL multiple collectives with significant assets. Others like ND have all eggs in one collective like UC does.

                    Texas ~5.8M in aggregate *appears one of their collectives is strictly for Baseball.

                    • I just took a stab at searching the IRS site for Cincy Reigns. They have not been approved as tax exempt yet, so no public filing of Form 990 was required.

                          • This is strictly NIL and not a legal thread issue. I've seen two different articles from Extra Points and the Athletic basically saying that the NIL problem will solve itself in acouple of years. Becuase of what happened with Dartmouth basketball yesterday, when the players get around to becoming employees of the university, it's extremely unlikely that NIL Collectives will continue to exist. The idea being that most donors aren't going to chip in money to pay, subsidize, or provide bonus money for the salary of an employee of the University.

                            In UC's world this probably means Cincy Reigns will eventually dissolve and some of it's functions will be brought back in house to the Athletic Dept.

                            As far as UCATS goes, I think it sticks around and that will continue to be an avenue for facilities upgrades and operations money to keep the engine running.

                            • I think that you may see more employee-athletes being fired due to performance. I wonder how this would have affected Colorado's off season last year where coach prime got rid of more than half of the team. In the PAC, the university must continue to pay for the athlete's scholarship if they somehow get cut from the team. With the new employee status, would that eliminate the requirement to continue to pay tuition for the fired athlete? This whole thing just creates a whole new can of worms.
